Welcome to Soulful: AI Character Maker ("Soulful", "App", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Soulful governing your download, access, and use of the Soulful mobile application and associated online services.

1. Eligibility and Account Registration

Soulful is intended exclusively for individuals aged 17 years or older. By creating an account or using the App, you warrant and represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Description of Services & AI Generation Disclaimer

Soulful provides an AI-powered platform that enables users to create virtual character personas, customize backstories and visual avatars, and engage in interactive synthetic dialogues ("Services").

• Fictional Nature: All AI characters, personas, personalities, and dialogue generated within Soulful are fictional and created algorithmically by artificial intelligence.
• Not Professional Advice: Soulful is provided for creative, storytelling, and entertainment purposes only. AI characters are not qualified professionals and cannot provide medical, psychological, legal, financial, or emergency advice. Never rely on AI responses in critical situations.

3. Content Moderation & User Conduct (Apple Guideline 1.2)

In strict compliance with Apple App Store Review Guidelines, Soulful maintains a Zero-Tolerance Policy for objectionable, abusive, or harmful content.

You strictly agree that you will NOT use Soulful to create, generate, upload, transmit, or share any content that:

• Is sexually explicit, pornographic, obscene, or depicts nudity;
• Promotes violence, terrorism, illegal activities, weapons, or hate speech against protected groups;
• Engages in harassment, bullying, stalking, defamation, or threats towards any individual;
• Encourages self-harm, suicide, or eating disorders;
• Infringes on the intellectual property, privacy, or publicity rights of third parties without proper authorization;
• Impersonates real-world living individuals without their express written authorization.

4. User Content and Intellectual Property

Your Content: You retain ownership of the text prompts, character definitions, and images you create and input into Soulful ("User Content"). By submitting User Content, you grant Soulful a non-exclusive, worldwide, royalty-free license to use, host, store, and process such content solely for the purpose of operating, maintaining, and improving the Services for you.

Our Proprietary Rights: The Soulful software, design, logo, user interface, brand assets, and proprietary algorithms are owned by or licensed to Soulful and are protected by international copyright, trademark, and intellectual property laws.

5. Auto-Renewable Subscriptions & In-App Purchases (Apple Guideline 3.1.2)

Soulful provides optional premium features through "Soulful Pro" auto-renewable subscriptions and consumables.

• Billing & Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew for the same duration (e.g., weekly, monthly, or annually) and price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal Charge: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing period at the then-current subscription rate.
• Subscription Management & Cancellation: You can manage your subscription and turn off auto-renewal at any time by navigating to your iPhone Settings > [Your Apple ID Name] > Subscriptions > Soulful.
• Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• Refunds: All purchases and refunds are processed solely by Apple in accordance with Apple's App Store Refund Policies.

6. Apple App Store Additional Terms & Standard EULA

These Terms supplement the standard End User License Agreement provided by Apple Inc. ("Apple").

• These Terms are concluded solely between you and Soulful, not with Apple. Soulful is solely responsible for the App and its content.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOULFUL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SOULFUL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP.

9. Account Termination

You may terminate your agreement at any time by deleting your account through the in-app Settings and deleting the App from your devices. Soulful reserves the right to suspend or terminate your account immediately without prior notice if you breach these Terms or engage in objectionable conduct.
